THE STATUTE OF
THE EUROPEAN MOVEMENT IN SERBIA
I GENERAL TERMS
Act 1
The European Movement in Serbia (herein after referred to as "the
Movement") is an independent and charity organisation of citizens
of Serbia.
The Movement is an independent institution of a democratic public
opinion and a form of gathering of citizens who advocate a peaceful,
democratic and all-European integration as well as a democratic
and modern Serbia as a part of Europe.
Act 2
The name of the organisation is:
- In Serbian (cyrillic and latin script): Evropski pokret u Srbiji,
Evropski pokret u Srbiji
- In Albanian: Levizija Evropeana ne Serbi
- In Hungarian: Szerbia i Europamozgalom
- In English: European Movement in Serbia
- In French: Mouvement Europeen en Serbie
The abbreviated form is: EPuS; EMinS.
Act 3
The Movement is a part of the international European non-governmental
organisation The European Movement (Mouvement Europeen - European
Movement.) It is seated in Brussels.
Act 4
The Movement will operate across the territory of the Republic
of Serbia.
Act 5
The seat of the Movement is in Belgrade. The address is 5, Djure
Jakšića Street, first floor.
Act 6
Aims of the Movement are:
- The improvement of understanding, mutual acquaintance and cooperation
between people, communities and countries across Europe and enhancing
versatile and free communication between them, first and foremost
in the areas of culture, communications, economy and politics;
- Spreading the idea of European unity in Serbia and inmproving
cultural, political and economic cooperation amongst citizens,
peoples, regions and countries in Europe as a European contribution
to peace and prosperity in the world with the aim of creating
a European federation (The United States of Europe);
- The democratic, federal Europe, based on the rule of right and
social justice, capable of protecting and developing human rights;
- Influencing the public of Serbia to direct their engagement
towards democratic activities in a multi-party system country
towards realising equality amongst people and their communities,
along with respecting and improving the standards adopted in Europe.
In order to implement these goals, the activities of the Movement
should imply acting:
- In favour of the idea of justice, and against any shape of violence
as well as against the ideologies based on instigating violence;
- In favour of resepcting human dignity and against the violation
of human rights;
- In favour of freedom of the citizen aware of his/her responsibilities
in the democratic order, and against totalitarianism and autocracy;
- In favour of the order of peace and democratisation in Europe,
and against war mongering and armaments;
- In favour of Europe as a unity of varieties, and against the
uniformity of nationalistic divisions;
Act 7
In the course of goals implementation, the Movement acts above
all through constant cooperation of its members in Serbia as well
as internationally, organisation of congresses, conferences and
symposiums, forming of commissions, work and study groups, publications,
organisation of expositions and manifestations dedicated to spreading
the results of work and research carried out by the Movement; education
and bringing up in the spirit of Europe, influencing the public
through the media, etc.
Act 8
The Movement cooperates with organisations from Serbia and abroad
that have similar goals.
Whether the Movement will join any of these organisations is decided
by the Assembly by two-thirds majority.
The shape and conditions of cooperation are decided by the Main
Board, whereas the organisation and implementation of the adopted
forms of cooperation are decided by the Executive Board.
II MEMBERSHIP
Act 9
Members can be both from Serbia and abroad, local and/or foreign
legal and/or natural persons.
The Main Board decides on membership applications.
The Movement includes:
- Individual members;
- Collective members;
- Associated members;
- Honorary members.
Act 10
Any person who is of age and who accepts the goals and the Statute
of the Movement can become a member.
Becoming a member requires a written application and reccommendations
from two individual members of EMinS. The signature on application
implies accceptance of the Programme Declaration and the Statute
of the Movement.
The Main Board of the Movement decides regarding member admission
and exclusion. Member may appeal to the Assembly regarding the Main
Board's decision and in case of appeal it is the Assembly that passes
the final decision.
Act 11
Organisation, enterprise or institution (association, union, scientific
institution, political party, etc.) that sits within the territory
of Serbia and accepts the goals and the Statute of the Movement
and, according to the assessment of the Main Board, can contribute
to the goals of the Movement being being carried out, may become
a collective member of the Movement.
Act 12
Organisation, enterprise or institution that wants to participate
in the activities of the Movement without the right to vote may
become an associated member of the Movement.
Act 13
Individuals who contributed in any particular way to carrying out
of the goals of the Movement may become honorary members of the
Movement.
Honorary members of the Movement are admitted in the organisation
by the Assembly and as proposed by the Main Board.
Act 14
Members of the Movement have a duty to show dedication to the goals
of the Movement.
Act 15
Members of the Movement pay membership fee.
Membership fee is determined by the Main Board.
Collective members and associated members pay a contribution and
the sum is particularly agreed upon between the Main Board and the
collective member.
Honorary members do not pay membership fee.
Act 16
Membership of individual members terminates if members leave the
Movement;
Membership of collective members terminates:
- If conditions from the Contract with the Movement come into
effect;
- If collective members cease to exist.
Membership may also terminate through exclusion. This decision
is passed by the Main Board in case any breach of obligations from
Act 14 occur.
Act 17
In carrying out its goals, the Movement stimulates a wide decentralisation
of its activities and creates a network of local councils of the
Movement which may be created in every territorial unit.
Act 17a
Local Council of the EMinS is established as a separate legal entity
and in order to implement the Programme of the Movement in adequate
local community -town or municipality.
Local Council has a separate bank account and a round stamp with
an impressed name of the European Movement in Serbia and the name
of the relevant local community as an extension to the name.
Local Council is established according to the regulations of the
Republic of Serbia and in accordance with the Statute of EMinS as
a separate organisation and a charity organisation of citizens of
the Republic of Serbia. It is established in order to work on the
implementation of the goals of the Movement within the adequate
local community.
The bodies of the Local Council are:
- President;
- Secretary General;
- Five-member Executive Board;
- Supervisory Board, and
- Assembly.
Local Council has a Statute which must be harmonised with the Statute
of the EMinS. The Statute of the Local Council is adopted by the
Assembly comprised of all members of the Local Council with prior
consent of the Main Board of the EMinS.
As initiated by its Executive Board, the Assembly of the Local
Council adopts its annual programme of activities provided that
they acquire consent of the Executive Board of the EMinS.
Secretary General of the Local Council is obligated to hand in
annual activity report to the Main Board of the Movement as well
as to regularly (at least once in two months) inform the Executive
Board regarding the current activities of the Local Council and
new members of the Movement.

Act 17c
Regional coordinators are appointed as executive officers of the
EminS in order to implement the Programme of the Movement within
the adequate community - region.
Regional coordinators are appointed and absolved by the Executive
Board of the Movement. Their decision is based on achieved results
in their work up until that moment and reputation they have as activists
in areas where they live.
The territory and the scope of work of the regional coordinators
are determined by the Executive Board of the Movement through passing
a decision.
Act 18
In representative bodies at all levels of the territorial organisation
of Serbia, groups comprised of representatives who are memebers
of the Movement or express readiness to supprot its goals or activities
may be formed.
III BODIES OF THE MOVEMENT
Act 19
The bodies of the Movement are:
- Assembly,
- The President of the Movement,
- Main Board,
- Executive Board,
- Secretary General, and
- Supervisory Board.
Act 19a
Committee for Budget and Finances is established as an expert body
of executive organs of the Movement.
The Committee for Budget and Finances performs the following tasks:
- Provides expert advice to executive organs of the Movement regarding
managing the financial resources of the Movement;
- Assists in preparation and review of financial reports for the
Main Board and the Assembly of the Movement.
The Committee for Budget and Finances is comprised of the President
and two members appointed and absolved by the Executive Board of
the Movement.
Act 20
The Assembly of the Movement is made up of at least 1/6 of the
total number of members:
- Representatives of the local (one representative per 20 members),
- Representatives if collective members (one representative per
one collective member),
- Members of the Main Board,
Other members of the Movement (individual, collective, associated
and honorary members) may participate in the work of the Assembly
in the quality of advisors.
Act 21
Regular sessions of the Assembly are held once a year.
The Assembly is chaired by the Presidnet of the Movement.
If needed, the Main Board may call for an emergency session of
the Assembly.
Act 22
The Assembly is authorised to deal with all issues not entrusted
by this Statute or the Assembly's decision as a competency to another
body of the Movement.
The Assembly particularly:
- Adopts and amends the Statute,
- Decides regarding the programme and plan of activities,
- Elects President, Secretary General and Vice-President of the
Movement;
- Elects members of the Main Board;
- Admits honorary members,
- Adopts budget, annual financial report and report of the Main
Board;
- Decides regarding the propositions of bodies or members of the
Movement;
- Decides regarding appeals on the Main Board's decisions;
- Confirms decisions of the Main Board regarding the membership
fee and the way it is collected.
Act 23
For the valid decision-making there need to be one half of the
total number of Assembly members present.
Decisions are passed by majority vote unless otherwise regulated
by the Staute.
In case the number of votes is equal, the vote that decides is
that of the Chairing person of the Assembly.
Act 24
Members of the Main Board ex officio are:
- The President of the Movement, who is also the President of
the Main Board ex officio;
- The Secretary General of the Movement;
- Former Presidents and Secretary Generals;
- Forum Presidents;
- Local Council Presidents;
- Regional coordinators;
- Presidents of organisations that are collective members of the
Movement.
The structure of the Main Board ensures adequate representation
of local councils.
The Main Board has at least 17 (seventeen) members and is called
when needed.
The mandate of the members of the Main Board lasts for 2 (two)
years.
Act 25
The Executive Board is an executive body of both the Assembly and
the Main Board and performs the following duties:
- Prepares and implements plans and programmes of the Movement;
- Organises activities that refer to international cooperation;
- Decides regarding contracts conclusion and accepting other official
documents which create the obligations of the Movement in terms
of financial plans;
- Decides regarding conditions and the way of funding of certain
projects implemented by or in which the Movement participates
with other persons in the country and/or abroad;
- Prepares propositions for decisions and other official documents
for the Assembly and/or the Main Board and carries out their orders;
- Proposes or adopts official documents of the Movement within
the limits of its authority;
- Takes care of the preparation of annual financial report and
adopts periodical reports;
- Prepares business reports, balance sheets and financial statements;
- Performs other duties as well and decides regarding issues not
placed under the authority of other bodies of the Movement by
this Statute.
The Executive Board ex officio consists of:
- The President of the Movement;
- The Secretary General of the Movement;
- Vice-Presidents (Presidents of Forums and project mangers);
- Deputy Secretary General.
The Executive Board is in session when needed and at least once
per month.
Act 26
The Main Board manages the activities of the Movement and represents
the Movement to third parties.
The Main Board is particularly authorised to:
- Compile a political programme and programme of activities as
well as to implement them;
- To harmonise the activities of Councils;
- To supervise the operation of the Executive Board;
- To establish commissions and work groups;
- To publish publications of the Movement;
- To supervise funds and finances of the Movement and particularly
to draft budgets and to realise them.

Act 30
The President of the Movement:
- Represents the Movement locally and abroad;
- Takes care of implementing the programme orientation of the
Movement;
- Chairs the Assembly of the Movement;
- Manages the operation of the Main Board.
The mandate of the President is 2 (two) years.
In case the President of the Movement is not at disposal of if
agreed with the President, the Secretary General or Vice-Presidents
may substitute the President of the Movement.
Act 31
Secretary General takes care of a valid operation of the Movement,
particularly of implementing the decisions passed by its bodies,
of stimulating, supporting and harmonising the operation of the
Movement. Secretary General manages the office, material and financial
business, concludes contracts and takes legal and other actions
related to the realisation of the determined financial obligations
of the Movement.
The Secretary General passes decisions regarding employing or dismissing
employees and may appoint his/her own Deputy. He/she ensures that
minutes are kept regarding the operation of all bodies of the Movement.
The mandate of the Secretary General lasts 2 (two) years.
Act 32
The Supervisory Board monitors financial business of the Main Board.
The Supervisory Board has at least 3 (three) members.
Members of the Main Board cannot be members of the Supervisory
Board.
The mandate of the Supervisory Board lasts 2 (two) years.
Act 33
Proposition for amendments to the Statute of the Movement may be
given by 10 (ten) members and the President.
IV MOVEMENT FUNDING
Act 34
Activities of the Movement are funded by:
- Membership fees of individual and collective members;
- Donations;
- Various forms of sponsorship and other activities.
Act 34a
The Movement is also funded by means intended for implementation
of projects that the Movement realises through its activities.
The Movement funding is transparent, it is subject to control both
by the bodies of the Movement and authorised auditors.
Act 35
The Movement is responsible for its obligations solely by all its
property.
Act 36
The funds of the Movement may be used solely based on financial
plans and within the adopted programme statement and plans of activities
of the Movement.
Order-issuing authority for using the funds of the Movement is
the Main Board, i.e. the President and the Secretary General.
The funds are on the local currency and foreign currency bank accounts
of the Movement.
Acting upon the proposal of the Main Board, the Assembly once a
year adopts the annual financial statement and financial plan for
using the funds of the Movement.
Act 37
The financial year overlaps witht he calendar year.
V INTERIM AND CLOSING TERMS
Act 38
The oepration of the Movement is public.
With the aim of informing the public, members of the Main Board
elect from one of them a person in charge of regular public relations.
The Movement also publishes its own publications.
Act 39
The decision regarding cease of existence of the Movement is passed
by the Assembly.
The proposition for cease of existence or operation of the Movement
may be given by 10 (ten) members or by the Main Board.
In case the Movement ceases to exist, the Assembly is obligated
to pass a decision regarding disposal of property. In case this
decision is not passed, the property of the Movement belongs to
the Republic of Serbia.
Act 40
The sign of the Movement is determined by the Main Board based
on a public advertisement issued for its design.
The sign may be used on the headed paper, publications as well
as to publicly mark and announce the activities of the Movement.
Act 41
The stamp of the Movement is of a round shape and it consists of
a circularly written name of the Movement in cyrillic script and
in the English Language. The right to use the stamp belongs to the
Main Board, i.e. the Secretary General, based on suitable regulations
and decisions.
Act 42
In accordance with the Statute, the Main Board determines or confirms
operation regulations of all bodies of the Movement by passing administrative
decisions that also include executive orders.
